Terms of service

These are the terms between you and Faresay Ltd, trading as Robin of Loxley, company number 17302034, for using MyOwnMenu. They're short on purpose. By signing up you accept them.
The service
MyOwnMenu is software for restaurants: a QR menu in Japanese and English, guest ordering from the guest's own phone, a kitchen display and a floor view. It's a business tool, for restaurants and the people who run them, not for consumers.
Plans and prices
- Menu: free. A digital menu with QR codes. It includes one menu photo import of up to 8 pages; after that you add and edit items by hand.
- Order: ¥4,980 a month per store. Everything in Menu, plus guest ordering, the kitchen display, the floor view and photo imports of up to 40 pages a month. The first 14 days are free, once per store.
- Setup fee: ¥0 on every plan. There's no contract term.
- Online payment for guests isn't available yet. When it is, it will be optional, and switching it on will cost 2.9% of each online payment. Orders paid at your till carry no fee from us.
- Plans shown as coming soon aren't on sale.
Tax: TODO(to fill in): say whether these prices include Japanese consumption tax, or fall under the reverse charge for services from abroad.
We'll give you at least 30 days' notice of a price change, by email, before it applies to you.
Billing
You pay by card through Stripe. When you start the Order trial you give a card at Stripe's checkout. Nothing is charged during the 14 days. If you don't cancel, the first month is charged when the trial ends, then every month on the same date.
If a payment fails, Stripe tries again and ordering stays on while it does. If the subscription ends unpaid, the store moves to the free Menu plan.
When a restaurant you referred pays its first invoice, one month at your current price is credited to your Stripe balance and taken off your next bill.
Cancelling and refunds
Cancel any time from the billing page, through Stripe's portal. Cancel during the trial and you pay nothing. Cancel later and the Order plan stays on until the end of the month you've paid for.
When the Order plan ends, the store moves to the free Menu plan. Your menu, tables and QR codes keep working; guest ordering turns off. Nothing is deleted.
We don't refund part months, except where the law requires it.
The subsidy bundle
For the デジタル化・AI導入補助金 we offer a 24-month bundle, paid once in advance: a ¥50,000 implementation fee plus 24 months of the plan. For Order that's ¥169,520. You can pay only after the programme has approved the application (交付決定).
The reimbursement comes from the programme, not from us, and we can't promise it. The bundle covers its plan for 24 months from payment. We don't refund unused months, except where the law requires it.
Your menu and your guests' data
Your menu, photos and orders are yours. You let us store and show them only to run the service for you.
You're responsible for what your menu says, including prices and allergen information. The photo reader can misread a menu: check every item before it goes live.
Guests' orders are your data. You're the controller and we process them only on your instructions, as set out in the privacy notice, which forms our data processing terms with you.
Fair use
- Don't use the service to break the law, mislead guests about prices or what they're ordering, or sell what you're not allowed to sell.
- Don't upload anything you don't have the right to use.
- Don't try to get at another store's data, overload the service or get around the free plan's limits.
- Don't resell the service without our agreement.
We can suspend an account that does these things. We'll tell you why, and where we can, we'll warn you first.
Availability
We work to keep the service running and your data safe, but we can't promise it will never go down. Keep a way to take orders without it, such as a paper menu. We may change or remove features; if a change takes away something you pay for, we'll tell you first.
Liability
Our total liability to you in any 12 months is limited to what you paid us in that time. We're not liable for lost profits, lost orders, lost data you could have exported, or losses that weren't foreseeable. Nothing here limits liability that the law doesn't allow us to limit, such as for fraud, or for death or personal injury caused by negligence.
Ending the agreement
You can stop using the service and ask us to delete your account at any time. We can end the agreement with 30 days' notice by email, or at once if you break these terms in a serious way.
Changes and law
If we change these terms in a way that matters, we'll email you before the change applies. We publish these terms in Japanese and English, and they're meant to say the same thing.
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. This doesn't take away any right you have under Japanese law that can't be excluded.
